TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your use of leeoskarharmonicas.com (the “Site”), including the Lee Oskar Harmonicas Store at leeoskarharmonicas.com/shop (the “Store”), and any purchase you make from the Store. The Site and the Store are operated by Lee Oskar Enterprises, Inc. (“Lee Oskar Harmonicas,” “we,” “us,” or “our”), a Washington corporation. By using the Site or placing an order, you agree to these Terms. If you don’t agree, please don’t use the Site or the Store.

Our HarmonicAlly™ app has its own terms and privacy policy, available at harmonically.app.

1. Who can use the Site and buy from the Store

You must be at least 13 years old to use the Site. To place an order you must be at least 18 years old, or have a parent or guardian who accepts these Terms on your behalf.

The Store sells and ships to customers in the United States only. Anyone in the world is welcome to browse the Site, but we can’t accept orders from, or ship to, addresses outside the United States; please see our Where to Buy page for the Lee Oskar distributor in your region. If you’re outside the United States, nothing in these Terms takes away rights you have under the mandatory consumer laws of your country.

2. Products, availability, and pricing

We work to describe and price products accurately, but we don’t warrant that descriptions, images, prices, or other content are complete or error-free. Prices are in U.S. dollars and may change at any time. We don’t try to undercut the independent retailers who carry our products; they’re how most people discover Lee Oskar Harmonicas, so you may well find a better price or a promotion from one of our dealers, and we’d encourage you to buy local when you can. If an item is listed at an incorrect price or with incorrect information, we may cancel or refuse any order placed for it, even after the order is confirmed; we’ll tell you and refund any payment taken.

3. Orders and acceptance

Your order is an offer to buy. We may accept or decline it for any reason, including availability, suspected fraud, errors in price or description, or quantity limits. A confirmation email means we received your order; it isn’t a guarantee that we’ve accepted it. We may limit quantities per person, household, or order.

4. Payment

Payment is due at checkout through the methods shown there, processed by Stripe, our third-party payment provider. By submitting payment you confirm you’re authorized to use the payment method. We don’t receive or store your full payment-card number; card processing is handled by Stripe. You’re responsible for any applicable sales tax, calculated at checkout where required.

5. Shipping, returns, and privacy

Shipping is governed by our Shipping Policy, returns by our Returns & Refunds Policy, and our handling of your information by our Privacy Policy. All three are part of these Terms.

6. Intellectual property

The Site and its content, including the Lee Oskar and Lee Oskar Harmonicas names and logos, product names such as Melody Maker, and all text, images, audio, video, and design, are protected by trademark, copyright, and other intellectual-property rights, owned by Lee Oskar Enterprises, Inc. and/or its licensors. All trademark and copyright rights are reserved. You may use the Site and the Store only to browse, learn, and buy for your own personal, non-commercial use. You may not copy, republish, sell, or otherwise exploit any part of the Site or its content without our prior written permission. You may link to the Site, but you may not frame it, present its content as your own, or suggest that we endorse you or your products without our written consent.

7. Content you send us

If you send us photos, reviews, stories, or other content (for example, a photo of you with your harmonica), you keep ownership of it, and you give us a non-exclusive, royalty-free, worldwide license to use, reproduce, edit for length or format, and display it on the Site and in our marketing. Send us only content you have the right to share, and nothing that violates Section 9.

8. Your account

If you create an account, you’re responsible for keeping your login secure and for activity under it. Tell us promptly if you suspect unauthorized use. We may suspend or close accounts that violate these Terms.

9. Acceptable use

You agree not to use the Site or the Store to break the law, infringe anyone’s rights, introduce malicious code, scrape or harvest data (including other people’s personal information), send spam, disrupt the Site’s operation, probe or test its security, or attempt unauthorized access to any system. You also agree not to post or send content that is unlawful, defamatory, obscene, hateful, harassing, or that infringes someone else’s rights. We may remove content and restrict access at our discretion, and we may cooperate with law enforcement where the law requires or allows it.

10. Third-party content and links

The Site includes links to, and embedded content from, third parties, for example videos hosted on YouTube and retailer and distributor websites listed on our Where to Buy page. We don’t control those sites or services, their own terms and privacy policies apply when you use them, and a link isn’t an endorsement. If you have a copyright concern about a video served from YouTube, please contact YouTube under its copyright policies and let us know as well.

11. Availability of the Site

We work to keep the Site and the Store available, but maintenance, technical problems, and events outside our control may interrupt them from time to time, and we may change or discontinue features without notice. We aren’t liable for any interruption, change, or discontinuance.

12. Product use and warranty

Harmonicas are acoustic instruments with reeds that wear through normal play; reeds going out of tune or wearing out with use is normal and is not a defect. Lee Oskar Harmonicas products are covered by the Limited Warranty set out in our Returns & Refunds Policy, which is your exclusive remedy for a defect. Except for that Limited Warranty and any rights you have under applicable law that can’t be waived, products and the Site are provided “as is,” and to the fullest extent permitted by law we disclaim all other warranties, express or implied; any implied warranties are limited to the duration of the Limited Warranty.

13. Limitation of liability

To the fullest extent permitted by law, Lee Oskar Enterprises, Inc. and its officers, employees, and suppliers won’t be liable for indirect, incidental, special, or consequential damages arising from your use of the Site, the Store, or any product, and our total liability for any claim won’t exceed what you paid for the product at issue. Some states don’t allow certain limitations, so some of these may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Lee Oskar Enterprises, Inc. from claims arising out of your misuse of the Site or the Store, content you send us, or your violation of these Terms.

15. Governing law and dispute resolution

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules.

Talk to us first. If you have a dispute, please email Sales@LeeOskarHarmonicas.com before starting a formal proceeding; most issues are resolved quickly. If we can’t resolve it within 60 days, either of us may begin arbitration as described below.

Binding individual arbitration. Except for the carve-outs below, any dispute arising out of or relating to these Terms or your use of the Site or the Store will be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, not in court. The Federal Arbitration Act governs this agreement to arbitrate. Arbitration will take place in Washington, by phone or video, or in your home county if you choose.

No class actions. Disputes will be brought only in an individual capacity, not as a plaintiff or class member in any class or representative action, and the arbitrator may not consolidate more than one person’s claims.

Carve-outs. Either party may still (a) bring a qualifying individual claim in small-claims court, and (b) ask a court for injunctive or other equitable relief to protect its intellectual-property rights.

Your right to opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing Sales@LeeOskarHarmonicas.com with your name and a statement that you opt out of arbitration. Opting out won’t affect the rest of these Terms.

16. General

These Terms, together with the Privacy Policy, Shipping Policy, and Returns & Refunds Policy, are the entire agreement between you and us about the Site and the Store and replace any earlier terms. If any part of these Terms is found unenforceable, the rest stays in effect and the unenforceable part will be read as narrowly as needed to make it enforceable. Our not enforcing a provision isn’t a waiver of it. You may not assign these Terms without our written consent. Provisions that by their nature should survive, including Sections 6, 7, and 12 through 16, survive any end of your use of the Site. To the extent permitted by law, any claim arising out of these Terms or your use of the Site must be brought within one year after it arises.

17. Changes

We may update these Terms from time to time. Changes take effect when posted, with a revised effective date. Continuing to use the Site or the Store means you accept the updated Terms.
